LaMezcla Music Terms and Conditions of Service

These Terms and Conditions of Service ("Terms") govern your access to and use of the LaMezcla Music application, website, and related digital services (collectively, the "Services") operated by LaMezcla Media Group, LLC("LaMezcla," "we," "us," or "our").
By accessing, registering for, purchasing a subscription through, or otherwise using the Services, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.
1. Eligibility and Acceptance of Terms
You must be legally capable of entering into a binding agreement in your jurisdiction to use the Services independently.
If you are under the age of legal majority in your jurisdiction, you may use the Services only with the permission and supervision of a parent or legal guardian, where permitted by applicable law.
You may not use the Services for unlawful or unauthorized purposes or attempt to interfere with, damage, disable, compromise, or gain unauthorized access to the Services, our systems, accounts, or networks.
We reserve the right to update these Terms from time to time. Updated Terms will become effective when posted through the Services unless otherwise required by applicable law. Your continued use of the Services after updated Terms become effective constitutes acceptance of those Terms.
2. LaMezcla Music Services
LaMezcla Music is a Latin music and entertainment platform that may provide access to content and features including, but not limited to:
- Music and music discovery
- Exclusive DJ mixes
- Curated playlists
- LaMezcla Radio and other audio programming
- Artist interviews and features
- Music and entertainment news
- Artist spotlights
- Live event information
- Giveaways and promotions
- Community features
- Premium or subscriber-exclusive content
- Other music, entertainment, cultural, and digital content
Some content may be available without registration, while other content or features may require a registered account or an active paid subscription.
The availability of specific content and features may change from time to time.
3. Accounts and Registration
Certain features of LaMezcla Music may require you to create an account.
When creating an account, you agree to provide accurate and current information and to maintain the security and confidentiality of your login credentials.
Your account is intended for your personal use. You may not share your login credentials in a manner that provides unauthorized access to restricted or subscription-only content.
You are responsible for activity conducted through your account, except where prohibited by applicable law.
If you believe your account or credentials have been compromised, please contact us at info@lamezcla.com.
We reserve the right to suspend or terminate accounts that violate these Terms, misuse the Services, engage in fraudulent activity, or threaten the security or integrity of LaMezcla Music.
4. Third-Party Sign-In Services
LaMezcla Music may allow users to create or access accounts using third-party authentication services, including Sign in with Apple or other supported authentication providers.
When using a third-party authentication service, certain information may be transmitted between that provider and LaMezcla as necessary to authenticate your account.
Your use of a third-party authentication provider is also subject to that provider's applicable terms and privacy policies.
Please review our Privacy Policy for additional information regarding how LaMezcla handles personal information.
5. Free and Premium Services
LaMezcla Music may offer both free and paid features.
Certain music, DJ mixes, programming, content, experiences, features, or sections of the Services may be available only to users with an active paid subscription.
The features included with a subscription may be described within the application before purchase.
LaMezcla may add, modify, replace, or discontinue particular content or features from time to time. An active subscription provides access to the subscription service and eligible content available during the subscription period; it does not constitute ownership of any individual piece of content.
6. Paid Subscriptions and Automatic Renewal
LaMezcla Music may offer automatically renewing subscriptions through supported platforms, including the Apple App Store and Google Play.
The subscription price, billing period, and applicable subscription benefits will be displayed before you confirm your purchase.
Subscriptions automatically renew unless canceled before the end of the current subscription period.
When a subscription renews, the applicable subscription fee will be charged through the payment method associated with the platform through which the subscription was purchased, subject to that platform's terms and billing practices.
Subscription pricing may change. Where required, users will receive notice or be asked to consent to applicable pricing changes according to the policies of the platform through which the subscription was purchased.
7. Apple App Store Subscriptions
If you purchase a LaMezcla Music subscription through Apple's App Store, payment will be charged to your Apple ID account in accordance with Apple's applicable terms.
Your subscription will automatically renew unless you cancel it before the end of the current subscription period in accordance with Apple's subscription policies.
You can manage or cancel an Apple App Store subscription through your Apple account subscription settings.
Deleting the LaMezcla Music App or deleting or discontinuing use of your LaMezcla account does not automatically cancel an active Apple App Store subscription.
Billing, payment processing, subscription management, cancellation, and applicable refund requests for purchases made through the Apple App Store are administered according to Apple's applicable policies.
LaMezcla does not directly receive or store your complete Apple payment-card information for App Store purchases.
8. Google Play Subscriptions
If you purchase a LaMezcla Music subscription through Google Play, payment will be processed through your Google Play account in accordance with Google's applicable terms.
Your subscription will automatically renew unless canceled in accordance with Google Play's subscription policies.
You can manage or cancel a Google Play subscription through your Google Play subscription settings.
Deleting the LaMezcla Music App or deleting or discontinuing use of your LaMezcla account does not automatically cancel an active Google Play subscription.
Billing, payment processing, subscription management, cancellation, and applicable refund requests for purchases made through Google Play are administered according to Google's applicable policies.
LaMezcla does not directly receive or store your complete Google Play payment-card information for Google Play purchases.
9. Cancellation and Refunds
You may cancel an automatically renewing subscription at any time through the platform through which you originally purchased the subscription.
Cancellation generally takes effect at the end of the current paid subscription period. Unless otherwise required by applicable law or the policies of the applicable app marketplace, canceling a subscription does not automatically generate a refund for the current billing period.
You will generally retain access to applicable subscription benefits until the end of your current paid subscription period.
For subscriptions purchased through the Apple App Store, refund requests are subject to Apple's applicable refund policies and processes.
For subscriptions purchased through Google Play, refund requests are subject to Google's applicable refund policies and processes.
Nothing in these Terms limits any refund or cancellation rights you may have under applicable law.
10. Restoring Purchases
Where supported, users who previously purchased an eligible subscription or in-app purchase may be able to restore that purchase through the LaMezcla Music application.
Restoration of purchases is subject to the account and platform through which the original purchase was made and the applicable policies of Apple, Google, or another authorized platform.
11. Intellectual Property and Content
Unless otherwise stated, the LaMezcla Music Services, including LaMezcla branding, logos, graphics, designs, text, original editorial content, software, and other proprietary materials, are owned by or licensed to LaMezcla Media Group, LLC and are protected by applicable intellectual property laws.
Music, recordings, artwork, photographs, videos, artist materials, trademarks, and other third-party content available through the Services may be owned by or licensed from their respective rights holders.
Access to content through LaMezcla Music does not transfer ownership of that content to you.
The Services and content are provided primarily for personal, non-commercial use.
Except where expressly permitted by law or authorized by the applicable rights holder, you may not reproduce, redistribute, sell, publicly distribute, modify, exploit, scrape, download, copy, or otherwise use protected content made available through the Services for unauthorized commercial purposes.
12. Acceptable Use
You agree not to:
- Use the Services for unlawful or fraudulent activities;
- Attempt to gain unauthorized access to LaMezcla systems, accounts, servers, or networks;
- Introduce viruses, malware, ransomware, spyware, or other harmful software;
- Circumvent subscription restrictions, access controls, or security measures;
- Copy or redistribute protected content without authorization;
- Interfere with the operation or security of the Services;
- Impersonate another person or organization;
- Use automated systems to improperly scrape or extract content or data from the Services; or
- Otherwise use the Services in a manner that violates applicable law or the rights of LaMezcla or third parties.
13. Community and User-Generated Content
LaMezcla Music may offer community features such as comments, reactions, submissions, polls, requests, or other interactive functionality.
If you submit or publish content through the Services, you represent that you have the necessary rights to submit that content.
Users may not submit content that is unlawful, threatening, harassing, fraudulent, defamatory, obscene, sexually exploitative, infringing, intentionally malicious, or otherwise violates applicable law or these Terms.
Users may not use community features to distribute malware, spam other users, impersonate another person, or engage in unlawful discrimination or targeted harassment.
LaMezcla reserves the right, but does not undertake an obligation except where required by law, to review, restrict, remove, or moderate user-generated content that violates these Terms or applicable law.
We may suspend or terminate access to community features or accounts for violations of these rules.
14. Third-Party Services and Links
LaMezcla Music may contain links to third-party websites, ticketing services, social media platforms, music services, advertisements, or other external services.
These third-party services are operated independently from LaMezcla unless expressly stated otherwise.
LaMezcla is not responsible for the content, privacy practices, availability, security, products, services, or transactions provided by independent third parties.
Your use of third-party services is subject to the applicable third party's own terms and policies.
15. Promotions, Giveaways and Events
LaMezcla may occasionally offer contests, giveaways, promotions, ticket opportunities, meet-and-greets, or other experiences.
Individual promotions may be governed by additional official rules, eligibility requirements, deadlines, restrictions, or terms. Where separate promotion rules conflict with these general Terms with respect to a particular promotion, the specific promotion rules will govern that promotion.
Event schedules, artist appearances, venues, ticket availability, and other event details may be changed or canceled by artists, promoters, venues, ticketing companies, or other third parties outside LaMezcla's control.
16. Availability and Changes to the Services
We work to provide a reliable experience but do not guarantee that every feature, stream, program, piece of content, or service will always be available or uninterrupted.
Content may be added, changed, removed, restricted, or made unavailable due to licensing, technical, editorial, business, legal, or other considerations.
We may modify, suspend, update, or discontinue portions of the Services when reasonably necessary.
17. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.
LaMezcla does not warrant that the Services will always be uninterrupted, error-free, completely secure, or free from technical issues.
Editorial, entertainment, event, artist, music, and other information provided through the Services is intended primarily for informational and entertainment purposes. Although we strive for accuracy, we do not guarantee that all information will always be complete, current, or error-free.
Nothing in this section excludes warranties or consumer rights that cannot legally be excluded.
18. Limitation of Liability
To the maximum extent permitted by applicable law, LaMezcla Media Group, LLC and its owners, employees, contractors, affiliates, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or inability to use the Services.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
19. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless LaMezcla Media Group, LLC and its affiliates, officers, employees, contractors, and representatives from claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights.
20. Suspension and Termination
You may stop using LaMezcla Music at any time.
LaMezcla may suspend, restrict, or terminate access to an account or portions of the Services if we reasonably determine that a user has violated these Terms, engaged in fraud or unlawful conduct, threatened the security of the Services, or materially infringed the rights of LaMezcla or others.
Termination of a LaMezcla account does not automatically cancel a subscription purchased through the Apple App Store, Google Play, or another third-party marketplace. Such subscriptions must be managed through the platform where they were purchased.
Provisions of these Terms that by their nature should survive termination will remain effective after termination.
21. Privacy
Your privacy is important to us.
Our collection, use, and handling of personal information in connection with LaMezcla Music is described in our Privacy Policy, which is made available through the application and/or LaMezcla's digital services.
Please review the Privacy Policy before using the Services.
22. Severability
If any provision of these Terms is determined by a court of competent jurisdiction to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary.
The remaining provisions will remain in effect.
23. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles, except where applicable consumer-protection laws require otherwise.
Any dispute relating to these Terms or the Services will be handled by a court of competent jurisdiction in Florida, subject to any rights or jurisdictional requirements that cannot legally be waived.
24. Changes to These Terms
LaMezcla may update these Terms as our Services, subscriptions, features, or legal obligations change.
When changes are made, we may update the "Last Updated" date at the top of these Terms and provide additional notice where required by applicable law.
Your continued use of the Services following the effective date of updated Terms constitutes acceptance of those changes, except where applicable law requires additional consent.
